A Horse Lease is a legally binding contract entered into by two parties with the agreement that the Lessorowner of the horse will be leasing his/her horse to the Lesseeperson leasing the horse for a fee or with the understanding that Lessee will be responsible for all care and boarding for the animal. Leasing a horse can be beneficial for both parties. If the Lessorowner is unable to devote time to training and riding the horse or has limited space for boarding the horse, the Lessor might consider leasing the horse to ensure the horse is maintained properly. If the Lesseeperson leasing the horse is unable to afford to purchase his/her own horse, but would like to ride for pleasure or train a horse for showing, then leasing can be a more economical option. This Horse Lease will allow the parties to define payment terms, standard of care, limitation on use of the animal, responsibility for care and maintenance, life insurance for the animal, right of first refusal in the event of sale and a number of other important terms to consider when entering a lease agreement.

4.24.530

Limitations on liability for equine activities Definitions.

Unless the context clearly indicates otherwise, the definitions in this section apply to RCW 4.24.530, 4.24.540, and section 3, chapter 292, Laws of 1989.

1 Equine means a horse, pony, mule, donkey, or hinny.

2 Equine activity means

a Equine shows, fairs, competitions, performances, or parades that involve any or all breeds of equines and any of the equine disciplines, including, but not limited to, dressage, hunter and jumper horse shows, grand prix jumping, threeday events, combined training, rodeos, driving, pulling, cutting, polo, steeplechasing, endurance trail riding and western games, and hunting;

b equine training and/or teaching activities;

c boarding equines;

d riding, inspecting, or evaluating an equine belonging to another whether or not the owner has received some monetary consideration or other thing of value for the use of the equine or is permitting a prospective purchaser of the equine to ride, inspect, or evaluate the equine; and

e rides, trips, hunts, or other equine activities of any type however informal or impromptu that are sponsored by an equine activity sponsor.

3 Equine activity sponsor means an individual, group or club, partnership, or corporation, whether or not the sponsor is operating for profit or nonprofit, which sponsors, organizes, or provides the facilities for, an equine activity including but not limited to Pony clubs, 4H clubs, hunt clubs, riding clubs, school and college sponsored classes and programs, therapeutic riding programs, and, operators, instructors, and promoters of equine facilities, including but not limited to stables, clubhouses, ponyride strings, fairs, and arenas at which the activity is held.

4 Participant means any person, whether amateur or professional, who directly engages in an equine activity, whether or not a fee is paid to participate in the equine activity.

5 Engages in an equine activity means a person who rides, trains, drives, or is a passenger upon an equine, whether mounted or unmounted, and does not mean a spectator at an equine activity or a person who participates in the equine activity but does not ride, train, drive, or ride as a passenger upon an equine.

6 Equine professional means a person engaged for compensation a in instructing a participant or renting to a participant an equine for the purpose of riding, driving, or being a passenger upon the equine, or, b in renting equipment or tack to a participant.

4.24.540

Limitations on liability for equine activities Exceptions.

1 Except as provided in subsection 2 of this section, an equine activity sponsor or an equine professional shall not be liable for an injury to or the death of a participant engaged in an equine activity, and, except as provided in subsection 2 of this section, no participant nor participant's representative may maintain an action against or recover from an equine activity sponsor or an equine professional for an injury to or the death of a participant engaged in an equine activity.

2 a RCW 4.24.530 and 4.24.540 do not apply to the horse racing industry as regulated in chapter 67.16 RCW.

b Nothing in subsection 1 of this section shall prevent or limit the liability of an equine activity sponsor or an equine professional

i If the equine activity sponsor or the equine professional

A Provided the equipment or tack and the equipment or tack caused the injury; or

B Provided the equine and failed to make reasonable and prudent efforts to determine the ability of the participant to engage safely in the equine activity, determine the ability of the equine to behave safely with the participant, and determine the ability of the participant to safely manage the particular equine;

ii If the equine activity sponsor or the equine professional owns, leases, rents, or otherwise is in lawful possession and control of the land or facilities upon which the participant sustained injuries because of a dangerous latent condition which was known to or should have been known to the equine activity sponsor or the equine professional and for which warning signs have not been conspicuously posted;

iii If the equine activity sponsor or the equine professional commits an act or omission that constitutes willful or wanton disregard for the safety of the participant and that act or omission caused the injury;

iv If the equine activity sponsor or the equine professional intentionally injures the participant;

v Under liability provisions as set forth in the products liability laws; or

vi Under liability provisions in chapter 16.04, 16.13, or 16.16 RCW.

4 Equine activity sponsor, an individual, group, club, partnership or corporation, whether or not operating for profit or nonprofit, or any employee thereof, which sponsors, organizes or provides the facilities for, an equine activity, including but not limited to pony clubs, 4H clubs, hunt clubs, riding clubs, school and collegesponsored classes, programs and activities, therapeutic riding programs and operators, instructors and promoters of equine facilities, including but not limited to stables, clubhouses, pony ride strings, fairs and arenas at which the activity is held;

5 Equine professional, a person engaged for compensation, or an employee of such a person engaged

a In instructing a participant or renting to a participant an equine for the purpose of riding, driving or being a passenger upon the equine; or

b In renting equipment or tack to a participant;

6 Inherent risks of equine activities, those dangers or conditions which are an integral part of equine activities, including but not limited to

a The propensity of any equine to behave in ways that may result in injury, harm or death to persons on or around it;

b The unpredictability of any equine's reaction to such things as sounds, sudden movement and unfamiliar objects, persons or other animals;

c Certain hazards such as surface and subsurface conditions;

d Collisions with other equines or objects;

e The potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within his ability;

7 Participant, any person, whether amateur or professional, who engages in an equine activity, whether or not a fee is paid to participate in the equine activity.

2. Except as provided in subsection 4 of this section, an equine activity sponsor, an equine professional or any other person or corporation shall not be liable for an injury to or the death of a participant resulting from the inherent risks of equine activities and, except as provided in subsection 4 of this section, no participant or a participant's representative shall make any claim against, maintain an action against, or recover from an equine activity sponsor, an equine professional, or any other person from injury, loss, damage or death of the participant resulting from any of the inherent risks of equine activities.

3. This section shall not apply to the horse racing industry as regulated in sections 313.050 to 313.720, RSMo. This section shall not apply to any employeremployee relationship governed by the provisions of, and for which liability is established pursuant to, chapter 287, RSMo.

4. The provisions of subsection 2 of this section shall not prevent or limit the liability of an equine activity sponsor, an equine professional or any other person if the equine activity sponsor, equine professional or person

1 Provided the equipment or tack and knew or should have known that the equipment or tack was faulty and such equipment or tack was faulty to the extent that it did cause the injury; or

2 Provided the equine and failed to make reasonable and prudent efforts to determine the ability of the participant to engage safely in the equine activity and determine the ability of the participant to safely manage the particular equine based on the participant's age, obvious physical condition or the participant's representations of his ability;

3 Owns, leases, rents or otherwise is in lawful possession and control of the land or facilities upon which the participant sustained injuries because of a dangerous latent condition which was known to the equine activity sponsor, equine professional or person and for which warning signs have not been conspicuously posted;

4 Commits an act or omission that constitutes willful or wanton disregard for the safety of the participant and that act or omission caused the injury;

5 Intentionally injures the participant;

6 Fails to use that degree of care that an ordinarily careful and prudent person would use under the same or similar circumstances.

5. The provisions of subsection 2 of this section shall not prevent or limit the liability of an equine activity sponsor or an equine professional under liability provisions as set forth in any other section of law.

6. Every equine activity sponsor shall post and maintain signs which contain the warning notice specified in this subsection. Such signs shall be placed in a clearly visible location on or near stables, corrals or arenas where the equine professional conducts equine activities if such stables, corrals or arenas are owned, managed or controlled by the equine professional. The warning notice specified in this subsection shall appear on the sign in black letters on a white background with each letter to be a minimum of one inch in height. Every written contract entered into by an equine professional and equine activity sponsor for the providing of professional services, instruction or the rental of equipment or tack or an equine to a participant, whether or not the contract involves equine activities on or off the location or site of the equine professional's or equine activity sponsor's business, shall contain in clearly readable print the warning notice specified in this subsection. The signs and contracts described in this subsection shall contain the following warning notice

Under Missouri law, an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities pursuant to the Revised Statutes of Missouri.

Sec. 5.

Purposes.

The General Assembly recognizes that persons who participate in equine activities may incur injuries as a result of the risks involved in those activities. The General Assembly also finds that the State and its citizens derive numerous economic and personal benefits from equine activities. Therefore, it is the intent of the General Assembly to encourage equine activities by delineating the responsibilities of those involved in equine activities.

Sec. 10.

5 The potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within his or her ability.

g Participant means any person, whether amateur or professional, who engages in an equine activity, whether or not a fee is paid to participate in the equine activity.

Sec. 15.

Participant's responsibility.

It is recognized that equine activities are hazardous to participants, regardless of all feasible safety measures that can be taken.

Each participant who engages in an equine activity expressly assumes the risk of and legal responsibility for injury, loss, or damage to the participant or the participant's property that results from participating in an equine activity, except in specific situations as set forth in Section 20, when the equine activity sponsor or equine professional may be held responsible. Each participant shall have sole individual responsibility for knowing the range of his or her own ability to manage, care for, and control a particular horse or perform a particular equine activity, and it shall be the duty of each participant to act within the limits of the participant's own ability, to maintain reasonable control of the particular horse or horses at all times while participating in an equine activity, to heed all posted warnings, to perform equine activities only in an area or in facilities designated by the horseman, and to refrain from acting in a manner that may cause or contribute to the injury of anyone.

Each participant, or parent or guardian of a minor participant, may execute a release assuming responsibility for the risks of engaging in equine activities. The release shall give notice to the participant, or parent or guardian, of the risks of engaging in equine activities, including i the propensity of an equine to behave in dangerous ways that may result in injury to the participant, ii the inability to predict an equine's reaction to sound, movements, objects, persons, or animals, and iii the hazards of surface or subsurface conditions. A release shall remain valid until expressly revoked by the participant or, if a minor, the parent or guardian.

Sec. 20.

Exceptions.

a This Act shall not apply to the horse racing industry as regulated in the Illinois Horse Racing Act of 1975.

b Except as provided in Section 15, nothing in this Act shall prevent or limit the liability of an equine activity sponsor, an equine professional, or any other person if the equine activity sponsor, equine professional, or person

1 Provided the equipment or tack, and knew or should have known that the equipment or tack was faulty, and the equipment or tack was faulty to the extent that it caused the injury.

2 Provided the equine and failed to make reasonable and prudent efforts to determine the ability of the participant to engage safely in the equine activity and determine the ability of the participant to manage safely the particular equine based on the participant's representations of his or her ability.

3 Owns, leases, rents, or otherwise is in lawful possession and control of the land or facilities upon which the participant sustained injuries because of a dangerous latent condition that was known to the equine activity sponsor, equine professional, or person and for which warning signs were not conspicuously posted.

4 Commits an act or omission that constitutes willful or wanton disregard for the safety of the participant, and that act or omission caused the injury.

5 Intentionally injures the participant.

Sec. 25.

Warning.

a Every equine professional shall post and maintain signs that contain the warning notice specified in subsection b of this Section. Signs shall be placed in a clearly visible location on or near stables, corrals, or arenas where the equine professional conducts equine activities if the stables, corrals, or arenas are owned, managed, or controlled by the equine professional. The warning notice specified in subsection b shall appear on the sign in black letters, with each letter to be a minimum of one inch in height. 4 Equine activity sponsor means an individual, group, club, partnership, or corporation, whether or not the sponsor is operating for profit or nonprofit, which sponsors, organizes, or provides the facilities for an equine activity, including, but not limited to pony clubs, 4H clubs, hunt clubs, riding clubs, school and collegesponsored classes, programs, and activities, therapeutic riding programs, stable and farm owners and operators, instructors, and promoters of equine facilities, including, but not limited to, farms, stables, clubhouses, pony ride strings, fairs, and arenas at which the activity is held.

a In instructing a participant or renting to a participant an equine for the purpose of riding, driving, or being a passenger upon the equine;

b In renting equipment or tack to a participant;

c To provide daily care of horses boarded at an equine facility; or

d To train an equine.

6 Inherent risks of equine activities means those dangers or conditions which are an integral part of equine activities, including, but not limited to

a The propensity of equines to behave in ways that may result in injury, harm, or death to persons on or around them.

b The unpredictability of an equine's reaction to such things as sounds, sudden movement, and unfamiliar objects, persons, or other animals.

c Certain hazards such as surface and subsurface conditions.

d Collisions with other equines or objects.

7 Participant means any person, whether amateur or professional, who engages in or any equine that participates in an equine activity, whether or not a fee is paid to participate in the equine activity.

773.02

General provisions.

Except as provided in s. 773.03, an equine activity sponsor, an equine professional, or any other person, which shall include a corporation or partnership, shall not be liable for an injury to or the death of a participant resulting from the inherent risks of equine activities and, except as provided in s. 773.03, no participant nor any participant's representative shall have any claim against or recover from any equine activity sponsor, equine professional, or any other person for injury, loss, damage or death of the participant resulting from any of the inherent risks of equine activities.

Limitation on liability for equine activity; exceptions.

1 This section applies to the horseracing industry as defined in chapter 550.

2 Nothing in s. 773.02 shall prevent or limit the liability of an equine activity sponsor, an equine professional, or any other person if the equine activity sponsor, equine professional, or person

a Provided the equipment or tack, and knew or should have known that the equipment or tack was faulty, and it was so faulty as to be totally or partially responsible for the injury;

b Provided the equine and failed to make reasonable and prudent efforts to determine the ability of the participant to engage safely in the equine activity, or to determine the ability of the participant to safely manage the particular equine based on the participant's representation of his or her ability;

c Owns, leases, rents, has authorized use of, or is otherwise in lawful possession and control of the land or facilities upon which the participant was injured, and the injury was due totally or in part, to a dangerous latent condition which was known to the equine activity sponsor, equine professional, or person and failed to post warning signs;

d Commits an act or omission that a reasonably prudent person would not have done or omitted under the same or similar circumstances or that constitutes willful or wanton disregard for the safety of the participant, which act or omission was a proximate cause of the injury; or

e Intentionally injures the participant.

773.04

Posting and notification.

1 Every equine activity sponsor and equine professional shall

a Post and maintain one or more signs which contain the warning notice specified in subsection 2. These signs shall be placed in a clearly visible location near to where the equine activity begins. The warning notice specified in subsection 2 shall appear on the sign in black letters, with each letter to be a minimum of 1 inch in height, with sufficient color contrast to be clearly distinguishable.

b Give the participant a written document which the participant shall sign with the warning notice specified in subsection 2 clearly printed on it. Said written document may be used in lieu of posting the warning on the site of the equine activity sponsor's or equine professional's facility, and shall be given to any participant in an equine event not on the location of the equine activity sponsor's or equine professional's facility.

2 The signs and document described in subsection 1 shall contain the following warning notice

WARNING

Under Florida law, an equine activity sponsor or equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities.

73.05

Limitation on liability of persons making land available to public for recreational purposes.

Nothing in ss. 773.01773.05 shall be construed to limit in any way the limitation of liability granted to private citizens who allow the public to use their land for recreational purposes, as provided in s. 375.251.

5 Equine professional means a person engaged for compensation

a In instructing a participant or renting to a participant an equine for the purpose of riding, driving, or being a passenger upon the equine;

b In renting equipment or tack to a participant;

c To provide daily care of horses boarded at an equine facility; or

d To train an equine.

6 Inherent risks of equine activities means those dangers or conditions which are an integral part of equine activities, including, but not limited to

a The propensity of equines to behave in ways that may result in injury, harm, or death to persons on or around them.

b The unpredictability of an equine's reaction to such things as sounds, sudden movement, and unfamiliar objects, persons, or other animals.

c Certain hazards such as surface and subsurface conditions.

d Collisions with other equines or objects.
